I'm sure this question has been asked before, but I couldn't find it. I wanted to know if soft plastic body designs are copywrited? I am trying to figue out if prefab worm molds can be used to produce plastic that will then be sold or if they can only be used to produce baits for personal use. Do I have to develop my own designs if I want to sell them. I know I'm getting ahead of myself considering that I'm just getting started, but I'd hate to spend a bunch of money on molds I can't use when I can desing my own baits. As I understand it, copy right is about the name you give to the bait, patent is the engineering of the bait, or the physical attributes that make it unique. Yes (I think) you can buy a mold and sell the baits. But if the resultant bait is in conflict with an existing patent, then that is your problem, not the mold makers. It is my firm belief that there are a ton of baits to be discovered out there. Those that believe that it has all been done before are living in a pessomistic dream. only a week ago, I discovered a new bait. It can be made in soft plastic or hard bait. It has an undulating up/down movement, rather than a side to side action. It will represent a craw or squid. It has not even been prototyped, but I am confident that it will work. Pitbull Baits Posted March 9, 2009 Report Share Posted March 9, 2009 Vodkaman is right on the design. I do buy molds and sell plastics them to people around town. But if your trying to go Berkley you might whant to design your own stuff. You can get many molds where you don't have to worry about lawsuits. Delw and them guys are preety good about not getting the customers sued over their molds they make. I guess thats their idea for keeping customers comming back to buy molds and out of court. The other reason I design my own baits is that I have a vivid imagination when it comes to soft plastic baits. What you see on my site is only about 20% of what I have designed. (site soon to undergo changes) I just did 2 more baits last week.
