Injected Plastic Hard Baits

Good luck trying to sue a Chinese manufacturer. LOL

Ain't that the truth. If you decide to try an overseas company to inject your baits you can forget about the added cost of a patent as it will be worthless.

 

The cost of getting the mold made is going to be a major part of the expense of producing a bait. You'll have to sell thousands of baits before you even begin to recover your expenses. Some of the guys who are schooled in computer design can give you a better idea of what all is involved in designing a mold, but it's not going to be cheap.

Im really looking at getting a mold made here in the US, i dont like to support forein places just my opinion.

About the patent, is it really nessasry if im dealing with companies here in the US? I know it's good to have one but then again is the injection molding company really going to take it and start selling of my design?

Fill me in i want to know the worst before the goods ;)

You don't need a patent and probably would not get one anyways, unless you have really designed something new. To protect yourself you should always have a lawyer draft up a contract between you and the mold maker and anyone in your supply chain that touches your product including EMPLOYEES. You need a non compete and non disclosure clause to make it binding. If someone does not want to sign it move on to the next company/person.

Then and only then you can sue their a***** off, at least in the USA.

Something you might want to consider before discussing your plans with anyone is to make a drawing of your concept along with detailed notes and put everything in a folder and then mail it to yourself.When you receive the package do not open it. This is proof as to the date you came up with the concept and finalized your plans for it.

 

You'll also want to keep records of any companies you contacted. The date, time, subject matter, etc. Depending on the laws of the state you live in it would be a good idea to record any conversations you have concerning the production and marketing of your lure. In Texas the law allows the recording of conversations as long as one of the individuals involved in the conversation knows it's being recorded. If memory serves me right this covers both phone and in person conversations. The laws of other states will vary so be sure to check into the laws for your state.

 

I doubt very seriously that a patent

 

will do you much good. The companies that you'll be fighting patent infringement against have really deep pockets and can keep any litigation tied up in court for years. By that time they could have produced millions of copies and will most likely have forced you into bankruptcy.

 

Not trying to frighten you away from pursuing your idea. There are some who have made it, but most will tell you it wasn't easy. The tenacity of a pit bull will certainly go a long way.

You cant mold it yourself from RTV and pour it with resin? If you want to get really intricate you can go as far as molding 2 separate halves and glue them together just like the big guys do. I saw a tutorial on youtube years ago were the guy took a name brand plastic lure carefully cut in half at the seam and then molded it. he then had a 2 piece rtv mold of each side and cast them then glued together....
