james bradshaw
If you are going to name your company, Lures, Colors and any other products. Please make sure you at least do an internet search before you use those names for your company and or products and services. Come up with your own name, don't use another companies name or name of their products for your own.[Maniac] Is a registered Trade mark for Maniac Custom Lures, for anything fishing or fishing related. That means you can't legally use it as your own. Thanks, James Bradshaw owner of Maniac Custom Lures,LLC
Baitjunkys
What is your registered trademark number. Quick search of trademarks netted nothing for maniac.

Bassinfool
Did this really warrant it's own thread?
smallmouthaholic
Did this really warrant it's own thread? Why not? Ignore the thread if you find it objectionable. There are folks on here that operate a legitimate business.A trademarked name registered w/ the U.S. Patent and trademark office will be vigorously defended. Registered Trademarks are more affordable to obtain today vs.25+ years ago. It's best to respect the legal rights of those who spend the time and $ to trademark their company name /and or baits.Receiving a cease and desists order from a legal firm over trademark infringement is no laughing matter. bryanmc
I'm not very "up" on trademark law. Would his granting of a trademark for a common work in the English language force someone who could document their use of the word before his application was made to stop using it? Does this mean that the word "maniac" is no longer allowed in any product name, ie. maniac blade, maniac crank etc or just as a company name? You cannot use that name referring to your own custom lures. That said, Maniac would stop most infringement if he had the this symbol ® @ the end of his logo. Once your fictitious Name /Logo is registered and a U.S. trademark granted ,you have exclusive use of that particular name associated w/ your company. That said ,it's always best to consult w/ legal counsel before assuming anything today concerning trademarks and patents. Coca-Coia- Pepsi- etc ring any bells? bryanmc
Looking at this from the above link it makes it look like he trademarked the single word Maniac. Maybe I'm just not understanding how it works. "On Wednesday, February 21, 2007, a U.S. federal trademark registration was filed for MANIAC by MANIAC CUSTOM LURES, LLC, BRIGHAM CITY, UT 84302. The USPTO has given the MANIAC trademark serial number of 77112175."

Vodkaman
I think this is a very good thread; a real situation has occurred which will now get resolved without contributing to the legal Christmas fund AND we all get to learn something. Perhaps james could be perswaded to come back and spill some first hand information on the subject. Dave
