madbass
Is the name "Senko" protected in any way? Or can anyone call their bait a Senko?
D.J.
I wouldn't advise using "Senko" You will probably get a visit from some high powered attorneys. I think I remember reading that Alsworms from this site got a nasty letter from GYCB because his stick bait is called the "Alsenko" Can you believe that. millsryno
I have not seen it trademarked, but like DJ said you probably just want to avoid using that. I'm sure he has more money than you and could hurt you. I thought that I read when a word because universally accepted as a term associated with a product, like Kleenex, it can't be trademarked. I may be wrong on this, but I swear I read that when I was researching trademarks.
Delw
The name senko applied to baits is protected, dont use the name if you are selling baits. about 2 years ago a few people had gotten letters from attorney's saying if they dont remove the name "senko" from the bait, webiste or packaging, they will get sued. So you can use for example 10 people out of 20 prefer (enter name here) more than senkos or Just as good as a senko if not better, you ahve to show the trademark symbol also and stats that senko is just used for comparison purposes only. One of my customers hired an attorney after getting a letter and this is what came out of it. there are some posts on it from the very begining of tackle underground actually lots of posts. I explained that mine is one word.....AlSenko.....not "Al's Senko". BUT......I wouldn't recommend using senko anywhere in the name. There are so many senko knock-offs now that most fishermen will know what one is regardless of what you call it.
nova
Never mind the legalities; using someones product name is just not good ethics.
Dungeonhawk5
senko is a japanese word for incense http://www.japanese-incense.com/incense-sticks.htm and a chinese word for something else... its used all over the pacific rim. Thats like me calling a liquid filled tube bait a "saki" and getting p*ssed off if someone wanted to use it... If he invented the word, fine, go for it, but he didnt, so its fair game as far as im concerned... NOW with that said.. I do not use that name on my sticks, I have done what the rest of you have and changed it, named it something different. I just think his whole argument is bush league. madbass
The reason I ask, is because there is someone on E-bay selling soft stickbaits and labeling them as Senkos (which they are not). I e-mailed him to warn him of the possible danger in doing that. The response I got was not very civil. He basically told me to go fly a kite! So much for friendly advice! P.S. I agree with 99% of what all of you said. I call mine Possum tails.

average_joe2000
Today in the mail I got a new BPS catalog, and I saw that G.Loomis is now selling rods that are designed to be used specifically with Senko's, and in the catlog, next to the word Senko, it had the little registered "r" mark. So I decided to do a trademark search online. What I learned was the word "Senko" is a registered trademark of Gary Yamamoto Custom Baits, Inc. and has been since 2001. Also, in the trademark record, it says that the word Senko translates as "a glint of light"...
